What personal data do we process?

Personal data refers to all information by which a natural person is identifiable or can be identified. A person is identifiable if that person's identity can reasonably be determined, directly or indirectly, without disproportionate effort. Directly identifying details include, for example, name, address and date of birth. Data that does not lead directly to an individual, but does do so with the help of other data, also comes under the definition of personal data. This might include an IP address, for example.

Business contacts

We process the personal data of employees of clients, growers, suppliers, distributors, consultants, and any other body with which we have a business relationship. The personal information about you that we might process includes:

Basis for processing personal data

If you – for example – place an order with us, deliver a product, collaborate with us, request information, make an appointment with us, or fill in a contact form, we process your personal data in order to carry out an agreement.

It may also be the case that Barenbrug has a legitimate interest in the processing of your personal data – for example for direct marketing. However, in every situation Barenbrug will make a thorough balance of interests between safeguarding your privacy on one hand and Barenbrug's legitimate interest on the other. Your personal data will only be processed on the above basis if Barenbrug's legitimate interest weighs more heavily.

In all other cases, we will request explicit permission for the processing of personal data. If you have given permission for your personal data to be processed, you are free to revoke this permission at any time.

We might share your personal data with third parties in order for specialist work to be carried out. Such work might include the handling of postal consignments, for example. We limit such sharing to an absolute minimum and require these third parties to handle your personal data with the greatest of care.

In addition, Barenbrug may provide your information to third parties if it has obtained your permission to do so or is entitled or obliged to do so by the applicable laws and/or regulations, by legal warrant or by court order.

Transfer to other countries

Your personal data will not be transferred to countries outside the EEA.

How long do we keep personal data?

We do not store your personal data for longer than is necessary for the purpose for which we have collected or processed it. Your personal data will not be stored longer than is required in order to comply with Barenbrug's legal obligation to retain such data.

Cookies

A cookie is a small file of information that is stored on your device (e.g. computer, tablet, smartphone or smartwatch) when you visit our website.

Most internet browsers are set to accept cookies automatically, but you can change your browser settings to refuse all cookies or to let you know when a cookie is sent. However, if cookies are disabled in your browser you may find that some features and services on our website (and on other sites) do not function properly.

Which cookies do we use on our website(s)?

Persistent cookies

The use of persistent cookies enables us to ensure that you don't need to repeat certain actions. They allow us to remember your preferences from a previous visit to our website. This saves you time and makes the website easier to use. You can delete persistent cookies using your browser preferences.

Session cookies

We activate session cookies during your visit to our site and they are automatically deleted as soon as you close the browser. Session cookies enable us to remember which parts of the site you have viewed during a visit and to tailor our services accordingly.

Google Analytics cookies

Google places cookies via our website as part of their Analytics service. We use this service to track visitor behaviour and to obtain reports on how visitors use our website. We can then use this information to improve our site. The purpose is thus not to retain personal data, but to keep track of your actions on the website.

Social media cookies

Our website contains buttons you can use to share our messages or web pages on social media. These enable you to 'like' things via Facebook or YouTube, or send a tweet using Twitter. These buttons work using small pieces of code that come from the social media platforms themselves. Cookies are placed via this code. We play no role in this. Barenbrug is therefore in no way liable for the manner in which these third parties respond to privacy legislation, and Barenbrug advises you to read the privacy policy of these third parties' websites in order to learn how such third parties handle your personal data.

Our own tracking cookies

We request a tracking cookie as soon as you visit our website. The resulting profile is not linked to your name, address, email address, etc.; it is only used to match advertisements to your profile to ensure that they are as relevant to you as possible.

Rights of data subjects

Objections

If you object to your personal data being used for direct marketing purposes, you can register your objection – without needing to provide a reason – by sending an e-mail. Barenbrug will cease to use the data on first request.

In all other cases, you can make an objection to the processing of your personal data due to special personal circumstances by sending an e-mail. Within four weeks of receiving the objection, Barenbrug will make a decision as to whether this objection is justified. In that case Barenbrug will cease the processing.

Correction, inspection, deletion, restriction and data portability

With regard to your personal data, you also have the right to:

  • correct it;
  • inspect it;
  • request its deletion, and;
  • transfer it.

You can also restrict the processing of your personal data and you have the right to prevent automated decisions.

If you wish to exercise these rights, you can send an e-mail. Barenbrug will contact you via e-mail within four weeks to let you know the extent to which it is able to fulfil your request. Corrections will be made if the personal data is factually incorrect, incomplete or not relevant for the purpose for which it was processed, or has otherwise been processed in contravention of the privacy regulations. Your rights may also be restricted when this is necessary in order to guarantee your protection, the rights or freedoms of others, or the enforcement of civil claims.

Complaints

In conclusion, we inform you that you have the right to submit a complaint to the Dutch Data Protection Authority regarding Barenbrug's processing of your personal data, if we have not handled or will not be handling your complaint satisfactorily.
